Minnesota State Bar Foundation 2007 Annual Report

The Minnesota State Bar Foundation exists for the express purpose of providing monetary grants to law-related programs and activities. These programs include legal assistance to the disadvantaged, improvements in the administration of justice, law-related education, and public interest legal work.

The Minnesota State Bar Foundation is organized as a 501(c)(3) nonprofit corporation in the state of Minnesota and operates independently of the MSBA. The Assembly of the MSBA serves as the members of the Foundation and elects the Foundation’s directors. The directors of the Foundation for 2006-2007 are Linda C. Barbe, Duluth; James P. Barone, St. Paul; Edward J. Blomme, Minneapolis; Judy Harris Brown, Duluth; Robert F. Enger, Bemidji; Richard Hendrickson, Osseo; Juan G. Hoyos, St. Paul; Nancy M. Kiskis, Minneapolis; Cynthia A. Jokela Moyer, Minneapolis; Warren Ortland, Minneapolis; Erin E. O’Toole-Tomczik, Elk River; the Hon. Jon Stafsholt, Glenwood; Gary L. Voegele, Faribault; Pamela J. Waggoner, Minneapolis; and the Hon. Lloyd B. Zimmerman, Minneapolis.

The Foundation Board meets to consider grant requests in March, June, September and December. The grant application form, on which all requests for funding must be submitted, is available from the MSBA office or at www.mnbar.org/foundat.htm. Applications are due no later than 5:00 p.m. in the MSBA office on the first working day of the month in which a Foundation Board meeting is held. 

MSBA members and others are encouraged to promote applications to the Foundation for law-related bar and community projects. Those interested in pursuing funding for bar projects should contact their MSBA staff liaisons in advance to discuss whether the proposed project is of the type the Foundation is likely to support. To discuss proposed community projects, contact Foundation staff.

The Foundation’s ability to fulfill its charitable purposes depends on the generosity of its donors. MSBA members are encouraged to contribute to the Foundation through the annual check-off on the MSBA dues statement and most of the Foundation’s contributions come through this source. A gift to the Foundation is a thoughtful way to commemorate the work, value or retirement of another lawyer. In memoriam gifts are excellent tributes. All gifts are tax deductible as charitable contributions. Contributions can be made to the Minnesota State Bar Foundation, 600 Nicollet Mall, Suite 380, Minneapolis MN 55402.

From July 1, 2006 to June 30, 2007, the Foundation received 72 grant requests totaling $269,916 and awarded 58 grants totaling $112,250. The amount awarded was 42% of the total requested. Eighty-one (81) percent of the proposals were acted on favorably. Of those receiving grants, three (3) received grants of the full amount requested. The average grant was $1,935; the largest grant was $6,000 and the smallest $500. 

While many projects actually fall into more than one category, looking only at the primary purpose of the grant awards, the purposes were as follows: legal assistance to the disadvantaged 60%, law-related education 28%, and administration of justice 7%.

Fulfillment of our mission also depends on wise stewardship of our endowment resources. During the past six (6) years, the Foundation has developed, adopted and implemented a new investment policy. As a result, the Foundation’s investments have grown from less than $700,000 as of June 30, 1996 to $1,180,496 as of June 30, 2006.

Examples of programs supported by the Foundation include the following:

Legal assistance to the disadvantaged programs including support for:

  • Legal advocacy services for victims of domestic violence
  • Legal services for Minnesotans living with HIV disease
  • Family law services for low-income parents
  • Legal services for metro-area clients age 55 and over who are unable to pay legal fees
  • Updating technology for legal aid providers
  • Stipends for summer law clerks in rural legal aid offices and grants to help defray law school debt payments for legal aid lawyers
  • A web-based resource for pro bono lawyers in Minnesota
  • Legal services for refugees and immigrants

Law-related education efforts including support for:

  • Law-related trainings for parents whose children have disabilities
  • Law-related trainings on landlord/tenant issues
  • Law-related trainings on child maltreatment

Administration of justice efforts including support for:

  • Activities that educate lawyers, judges and law students about chemical dependency and mental health issues
  • Programming to link law student volunteers with pro bono attorneys
  • Loan repayment support for legal services attorneys

Katrina Relief

This year the Foundation was pleased to continue administrating the MSBA’s Katrina Relief Fund. The following amounts were distributed through the fund in 2006-07.

Southeast Louisiana Legal Services $2,525.95 (legal services assistance)
Legal Services Alabama  $982.32 (legal services assistance)
Pro Bono Project (New Orleans)  $1,262.98 (legal services assistance)
Mississippi Center for Legal Services  $2,245.29 (legal services assistance)
Shipping Costs for Donated           Furniture  $10,754.20 (two semis to Louisiana)
Total:  $17,770.74

In addition, many tens of thousands of dollars worth of office furniture was donated and shipped to the Gulf Coast in both 2005-06 and 2006-07.

I would like to recognize and thank former MSBA President Susan Holden (2005-06) for her leadership on the Katrina Relief effort as well as Fred Finch and the Honorable Cara Lee Neville for chairing the task force. I would also like to recognize the many other MSBA members who donated their time to this project, including Richard Hawke for tirelessly coordinating the shipping. The Foundation and the MSBA continue to receive kind words and expressions of gratitude from the Gulf Coast as a result of this fine effort.
