The U.S. Constitution states, "The Times, Places and Manner of holding Elections for Senators and Representatives shall be prescribed in each State by the Legislature thereof." This CLE will explore the right to vote within the context of both Federal and State Constitutional law. For better or worse, Minnesota has recently found itself in the election law spotlight: the poster child for the intricacy of these issues. Our distinguished presenters will analyze lessons to be learned from past events, notably the 2008 Senate election recount, as well as possible future challenges; including the possibility of the Office of Administrative Hearings handling the responsibilities of the canvassing board and the potential loss of a state congressional seat following the 2010 census. The panelists will also help you understand the background and implications of Minneapolis' battle to conduct its municipal elections by Instant Run-Off (ranked choice) Voting.
