The MSBA Antitrust Section Presents


"Class Actions: Same Rules but New Challenges"

This discussion will address recent developments in class action law that will likely impact antitrust practitioners. Those developments concern the impact of arbitration clauses on class certification (Stolt-Nielsen (S.Ct. 2010); the evolving standards for proving the Rule 23 requirements (Dukes (9th Cir. 2010); American Honda (7th Cir. 2010)); and recent challenges to the efficacy of the class device (DeBeers (3d Cir. 2010); Baycol (8th Cir., cert granted 2010)).


W. Joseph Bruckner , Partner, Lockridge Grindal Nauen P.L.L.P.
Joseph Bruckner is a partner at Lockridge Grindal Nauen P.L.L.P., and leads the firm's antitrust law practice. He is regularly appointed lead or co-lead counsel for plaintiffs by courts across the nation in complex multidistrict class action antitrust litigation. Mr. Bruckner was a law clerk to the Honorable Donald P. Lay (then Chief Judge of the United States Court of Appeals for the Eighth Circuit), and is a past chair of the Minnesota State Bar Association Antitrust Law Section.

Joel Mintzer , Partner, Robins, Kaplan, Miller & Ciresi L.L.P.
Mr. Mintzer's practice focuses on complex litigation, often involving multi-jurisdictional, class action, and bankruptcy issues. He served as a law clerk to the Honorable Harold D. Vietor of the U.S. District Court for the Southern District of Iowa.
