Bankruptcy is "hot" again.  Lawyers new to the practice are flooding into bankruptcy practice; former bankruptcy lawyers are returning; experienced bankruptcy lawyers in consumer and commercial practice are swamped. This scenario is ripe for professional discipline issues. Bankruptcy poses all of the normal professional discipline issues for lawyers, as well as special ones imposed by Sections 327 through 329 of the Code. Judge Dreher will discuss anecdotally some of her recent experiences with disciplinary matters and provide tips for avoiding problems. The program will touch upon criminal referrals (such as the Gellene case), Chapter 11 issues (as in Sonic Blue and West Delta), and issues of special importance to consumer practices.
