"The Absolute Priority Rule in Individual Chapter 11 Cases: Deciding What Congress Meant and Practical Implications for Practitioners"
Two recent cases from the Fourth and Tenth Circuits move the weight of precedent, both in number and seniority of courts, even further toward preservation of the absolute priority rule in individual chapter 11 cases. The presentation will examine both sides of the debate and discuss what the current state of the law means for debtors and creditors.

Doug Kassebaum practices in Fredrikson & Byron’s Bankruptcy, Restructuring & Workout Group. Doug has extensive experience representing business and individual debtors in Chapter 11 cases. Doug has spoken at local, regional and national events and written materials on personal insolvency issues such as individual Chapter 11 cases and personal guaranties, as well as general business bankruptcy issues. Doug is a 2006 graduate of the University of Wisconsin law school.
