"Preserving Electronically Stored Data . . . and How the Heck Am I Supposed to Preserve All That Social Media/Smartphone Evidence?"

Currently Minnesota lawyers must search for law from other jurisdictions to obtain guidance on how to identify and preserve ESI in Minnesota cases. Minnesota ESI Working Group 3 was charged with defining for Minnesota lawyers the technologies and best practices for preservation of ESI in Minnesota. The results will be published in a White Paper listing and defining the variety of different forms of ESI used at work and at home, such as websites, social media, text messages, smart phones, backup tapes, the "cloud," and voicemail/VOIP. The Paper describes how Minnesota litigants are locating and preserving these various forms, and it also provides a bibliography of resources available to Minnesota practitioners.
