"Technology Licensing – Potential Hazards at the Intersection of Antitrust and IP Law"

The courts and antitrust enforcement agencies have revised their skeptical attitude toward IP licenses since the "Nine No No's" of the 70's. The pro-competitive aspects of IP licenses are now emphasized in the Justice Department / FTC joint Guidelines for Licensing Intellectual Property, but a number of licensing arrangements and specific license terms can restrict competition in ways that will still draw antitrust scrutiny. This program will identify some of the potential trouble spots and discuss the antitrust issues that can arise.

Presenter:

Tom Sheran , Moss & Barnett, P.A.
Tom Sheran is a shareholder at the Moss & Barnett firm here in Minneapolis. His practice includes business and commercial litigation as well as antitrust counseling and transaction work in the field of information technology. He is a past chair of the Computer & Technology Section as well as the MSBA Antitrust Section. He has a graduate degree in software systems from the University of St. Thomas. He has taught antitrust law at Hamline University Law School and is currently teaching a course on legal aspects of managing technology as part of St. Thomas' Graduate Programs in software.
