If you think
that multi-player online role-playing games (MMORPGs) are merely
an esoteric topic, think again. In the last year, the New York
Times and the Wall Street Journal carried frequent articles
on legal developments and lawsuits concerning Second Life, World
of Warcraft, and other popular games that attract millions of users.
These articles supplement an already robust literature on legal
rights and duties in virtual worlds. The ABA Subcommittee on Electronic
Commerce has recently compiled an extensive list of legal issues
in MMORPGs, including how much the user agreement can create and
constrain parties' rights and duties; whether users gain property
rights and IP rights in characters, attributes, and other tradeable
virtual items; taxation of income from the trading of virtual items;
torts and crimes committed in virtual world (vandalism, rape, child
molesting, murder); banking and securities activities "in-world";
FTC regulations on advertising and pre-texting; and---everyone's
favorite topic---jurisdiction.
Join Professor Lunz for an engaging discussion on a topic that keeps
getting more interesting every week. And if you think your clients
aren't part of this world, you might be surprised to learn that
they are.
