Many businesses have taken comfort in the U.S. attitude regarding consumer data privacy and security regulation, which targets the kinds of businesses charged with protecting their customers’ and clients’ data and seemingly spares other businesses from the burden of regulation. But hidden within those statutes and regulations lies a potential trap for an unwary vendor. Many of the laws contain provisions that require regulated entities to obtain contractual promises from their third-party service providers who may have access to protected data. So, these “unregulated” entities may become ensnared in nearly identical obligations when their customers demand contractual obligations for providing data security.
