A subcommittee of the MSBA Construction Law Section worked for many months developing model case management orders to govern multifamily and single family residential construction defect cases filed in Minnesota State District Court. Both plaintiff and defense counsel were represented on the special committee. The model orders, which were endorsed by the MSBA Construction Law Section as a whole at its December, 2008 meeting, provide for certain automatic disclosures and establish timeframes for these cases, which can be very difficult for the courts and counsel to manage. The model orders are just that, they are models that may be proposed to the Court in lieu of standard scheduling orders in residential construction defect cases. In the coming months, members of the subcommittee will be conducting outreach to members of the bench to introduce the model orders. Join ProJusticeMN.org!
