The qualified plan audit season is underway, and the inquiring mind of the auditor wants to know all about any actual or possible claims against the plan. Your job, it seems, is to say as little as possible, which you probably do by answering the auditor's form letter with a form letter of your own. A panel of three--an auditor and two employee benefit attorneys--will dig into the substance behind these forms from the perspective of the plan auditor, outside counsel and the client.
These varied perspectives will provide you with a practical look at the attorney client privilege, at how the privilege impacts what the attorney should and should not tell the auditor and whether the attorney's client is the plan sponsor or the plan itself. You will also be updated on the ABA Statement of Policy Regarding Lawyers’ Responses to Auditors’ Requests for Information.
