Private mediation that settled two-year-old employment lawsuit, 1
Informal mediations and negotiations not labeled as such
In 2000 alone, I have helped two clients who thought they wanted to sue when they approached me. Working with them, I have instead reached positions for them where they continue to benefit from the employer-employee relationship. They did not hire me to mediate: I persuaded them that they did want to hire me to fix their problem.

Familiarity and Experience with State and Federal Labor and Employment Laws
My first work on an extensive lawsuit occurred for the defense, beginning in 1993, in a $2.6 million claim with six plaintiffs, filed under MHRA. The case(s) went up through the appellate levels three times. We won on five of the six plaintiffs.

Since then, I have assisted on EEOC claims, Title VII claims, and other, smaller MHRA cases. I have only passing familiarity with union law, although unions have been peripheral in a few cases on which I have assisted.

Other Factors
I am distinctively creative in approaching problem solving. I also really like to reach results that serve both parties. That atmosphere is contagious and often leads to the parties being on their best behavior, actively seeking to find an answer that is both reasonable and rational.

I don’t always work my magic. Sometimes the gulf is too great or one party’s resistance too entrenched. I still take satisfaction in whatever movement I am able to accomplish.
