2013 Minnesota Laws of Interest to Public Lawyers

In the early part of the 2013 session of the Minnesota Legislature, the focus of enactments has largely been on health care and the implementation of the federal Affordable Care Act in Minnesota.  In the latter half of the session, the legislators are expected to turn their focus to the state budget for fiscal years 2014-2015.  Read more for measures enacted thus far which may be of interest to public lawyers.

Clarence Gideon is not an easy man to befriend. But forty years after Gideon’s death, and 50 years after the landmark case that Gideon brought to the United States Supreme Court, District Court Judge Kevin S. Burke hopes that Minnesota lawyers will remember the man and his case. Judge Burke worries that we are making the same choices today that brought about the tragedy of an unjust prison sentence for Gideon, and Burke hopes that you will do something about it. There was a great turnout of public attorneys at the last Loaves and Fishes on April 3.  We sponsor the meal again on June 5.  Please join us!  We arrive at Holy Rosary Catholic Church, near Cedar Avenue South and 24th Street in Minneapolis, at 2:30 p.m. and begin preparing the meal. (The Public Law Section purchases the food and prepares the meal of tator tot hot dish, green beans, peanut butter and jelly sandwiches, and oranges.)  Following the food prep, we clean the kitchen and prepare the room for the guests.  Contact Nancy McLean at  for directions and details.

The ABA Mid Year Meeting in Dallas

The Council of the ABA’s Government and Public Sector Lawyers Division (GPSLD) met in Dallas in February 2013 as part of the ABA’s Mid-Year Meeting. The Council voted on several ABA resolutions for consideration by the House of Delegates and planned upcoming CLEs and business meetings. Read More...

Mary Miller Retirement: MSBA Public Law Section Council Member and Minnesota Department of Labor and Industry attorney, Mary Miller, retired in April after a long and distinguished career as a public lawyer. Mary served as Special Counsel and Division Counsel to the Workers Compensation Division before she became General Counsel for the Department of Labor & Industry. She has been an active member of the Public Law Section for over a decade, serving as co-chair and officer for several years.

Desyl Peterson Retirement: Long-time Minnetonka City Attorney Desyl Peterson retired this spring. Over the years, Desyl was a member of the Minnesota City Attorneys Association and the International Municipal Lawyers Association (IMLA). Desyl received the MSBA Public Attorney Award of Excellence in 2000 and a national award from IMLA in 2003. Prior to becoming Minnetonka City Attorney, Desyl Peterson was an attorney at the law firm of Popham, Haik in Minneapolis. She is a graduate of the University of Minnesota Law School.

New Fees: The Judicial Conference of the United States approved a new $50 administrative fee for filing a civil action, suit, or proceeding in a district court. As a result, the fee for filing a civil case will increase from $350 to $400 effective May 1, 2013.
