Mr. Kaplan will review the law of privilege in the tax practice, including a corporate taxpayer's possible loss of those privileges in complying with its FIN 48 and FAS 5 liability analyses and disclosures. Among other issues, he will address the recent Textron litigation, its conflict with Adlman, and the privilege claims that may remain available with respect to the taxpayer's and auditor's "tax accrual workpapers."
